1. Acceptance and Scope

These Terms govern your use of learn.hekax.com and any related products, digital downloads, and community access provided by HEKAX. By accessing or purchasing, you accept these Terms and our Refund Policy and Cookies Policy.

2. Eligibility and Account Responsibility

You are responsible for all activity under your account, including maintaining credential security and restricting access to your login. You must provide accurate account and billing information.

3. License and Permitted Use

We grant a limited, revocable, non-exclusive, non-transferable license for your personal or internal business learning use. You may not sublicense, resell, redistribute, or publicly mirror paid content.

4. Prohibited Conduct

• Sharing or selling account access, files, downloads, or private community access.
• Scraping, copying at scale, reverse engineering, or bypassing security/rate limits.
• Uploading malware, abusive content, or using the service for unlawful activity.
• Infringing third-party rights, including copyright, trademark, and privacy rights.

5. Payments, Access, and Changes

Prices, product structure, and included benefits may change at any time for future purchases. Access is tied to the purchasing account. We may update, replace, or retire features and content while preserving already-granted core access where commercially reasonable.

6. Educational Content Disclaimer

Content is provided for educational purposes only and does not constitute legal, tax, accounting, investment, or financial advice. You are solely responsible for how you apply any material, including AI and Web3 workflows.

7. Intellectual Property

All platform content, branding, design, and materials remain the property of HEKAX or its licensors. No rights are granted except those explicitly stated in these Terms.

8. Enforcement, Suspension, and Termination

We may suspend or terminate access without notice for fraud, abuse, policy violations, chargeback abuse, or security threats. In such cases, refunds are not guaranteed.

9. Warranty Disclaimer

Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted availability.

10. Limitation of Liability

To the maximum extent permitted by law, HEKAX is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages. Our total aggregate liability for any claim related to the service is limited to the amount you paid to us for the relevant purchase.

11. Indemnification

You agree to defend, indemnify, and hold harmless HEKAX from claims, losses, liabilities, damages, and costs arising from your misuse of the service, violation of these Terms, or infringement of third-party rights.

12. Governing Law and Disputes

These Terms are governed by applicable law in the jurisdiction where HEKAX operates, without regard to conflict of law principles. You agree to resolve disputes in the competent courts of that jurisdiction, unless applicable law requires otherwise.

13. Changes to Terms

We may update these Terms at any time. Updated Terms become effective when posted. Continued use after changes constitutes acceptance of the revised Terms.
